تنظم هذه الشروط استخدامك لموقع sikka28.com وبوابة العملاء التابعة لعلامة سكّة 28، وهي علامة تجارية تابعة لشركة سنابل الحلول للتقنيات (شركة سعودية مسجلة، ويُشار إليها فيما يلي بـ "نحن"). باستخدامك للموقع أو البوابة فإنك توافق على هذه الشروط.
الخدمة
يقدم الموقع معلومات عن خدمة بناء المنتجات الرقمية خلال ثمانية وعشرين يوماً ونموذجاً لطلب الحجز. أما بوابة العملاء فهي مساحة خاصة يتابع فيها العميل مشروعه، ويراجع وثيقة النطاق والعروض، ويطلع على الدفعات والطلبات، ويتواصل مع فريق العمل.
المعلومات المنشورة في الموقع، ومنها المدد ونطاقات الأسعار، هي معلومات عامة وتقريبية. وتُحدد تفاصيل أي مشروع، ومنها النطاق والسعر والمواعيد والالتزامات، في وثيقة النطاق والعقد الموقّع بين الطرفين، وعند أي تعارض يُعمل بالعقد.
الحسابات
- حسابات البوابة تُصدر من قبلنا لعملائنا ومن يفوضونهم، ولا يوجد تسجيل عام.
- أنت مسؤول عن الحفاظ على سرية بيانات الدخول وعن كل ما يتم من خلال حسابك، وعليك تغيير كلمة المرور المؤقتة عند أول دخول وإبلاغنا فوراً عند الاشتباه بأي استخدام غير مصرح به.
- لصاحب الحساب لدى العميل إضافة أعضاء من فريقه وتحديد صلاحياتهم، ويتحمل العميل مسؤولية تصرفاتهم داخل البوابة.
- القرارات والموافقات التي تُسجل في البوابة من الحساب المخول تُعد صادرة عن العميل ونافذة في حقه.
الاستخدام المقبول
تلتزم باستخدام الموقع والبوابة لأغراض مشروعة فقط، وبعدم محاولة الوصول إلى بيانات أو حسابات لا تخصك، أو الإخلال بعمل الخدمة أو أمنها، أو رفع محتوى مخالف للنظام أو يمس حقوق الآخرين. ويحق لنا تعليق أو إيقاف أي حساب يخالف ذلك.
المحتوى والملكية الفكرية
- محتوى الموقع والبوابة، ومنه النصوص والتصاميم والشعارات والعلامات، مملوك لنا أو مرخص لنا، ولا يجوز نسخه أو استخدامه دون إذن كتابي.
- المحتوى والملفات التي يرفعها العميل تبقى ملكاً له، ويمنحنا حق استخدامها بالقدر اللازم لتنفيذ المشروع.
- ملكية مخرجات المشروع وشروط نقلها تُحدد في العقد. وبحسب نموذج الخدمة، تُسلّم المخرجات إلى حسابات العميل عند اكتمال المشروع وسداد المستحقات وفق ما ينص عليه العقد.
الدفعات
الدفعات ومواعيدها وطريقة سدادها تُحدد في وثيقة النطاق والعقد، وتُعرض في البوابة للمتابعة. الفواتير والإيصالات التي تظهر في البوابة هي لغرض التوثيق والمتابعة، وتبقى المستندات الموقعة أو الصادرة رسمياً هي المرجع.
المدد والمواعيد
عدّاد المشروع ومواعيد المحطات في البوابة تعكس ما تم الاتفاق عليه في العقد، بما في ذلك حالات التوقف المؤقت عند تأخر المدخلات أو القرارات من جهة العميل، وأي تعويض عن التأخير من جهتنا يكون وفق ما ورد في العقد وبالحد الأعلى المنصوص عليه فيه.
التوافر والتغييرات
نسعى لإبقاء الخدمة متاحة على الدوام، إلا أننا لا نضمن خلوها من الانقطاع أو الأخطاء، وقد نجري صيانة أو تحديثات أو تغييرات على الخدمة من وقت لآخر.
حدود المسؤولية
يُقدم الموقع والبوابة بحالتهما دون أي ضمانات ضمنية تتجاوز ما ورد في العقد. وفي الحدود التي يجيزها النظام، لا نتحمل مسؤولية أي خسائر غير مباشرة أو تبعية تنشأ عن استخدام الموقع أو البوابة أو تعذر استخدامهما، ولا تتجاوز مسؤوليتنا الإجمالية تجاه العميل بشأن أي مشروع المبالغ المدفوعة لنا عن ذلك المشروع، ما لم ينص العقد على خلاف ذلك.
الإنهاء والتعليق
يحق لنا تعليق أو إنهاء الوصول إلى البوابة عند مخالفة هذه الشروط أو عند انتهاء العلاقة التعاقدية، مع مراعاة حق العميل في الحصول على بياناته ومخرجات مشروعه وفق العقد.
النظام الواجب التطبيق
تخضع هذه الشروط لأنظمة المملكة العربية السعودية، وتختص جهاتها القضائية بالنظر في أي نزاع ينشأ عنها، ما لم ينص العقد على آلية أخرى لتسوية النزاعات.
التعديلات
قد نحدّث هذه الشروط من وقت لآخر، وتسري النسخة المنشورة على هذه الصفحة من تاريخ آخر تحديث. استمرارك في استخدام الخدمة بعد التحديث يعني موافقتك على الشروط المحدثة.

These terms govern your use of sikka28.com and the client portal of Sikka 28, a brand of Sanabel Technology Solutions (a registered Saudi company, referred to below as "we"). By using the website or the portal you agree to these terms.
The service
The website presents our service of building digital products in twenty eight days and offers a booking form. The client portal is a private space where a client follows their project, reviews the scope document and the demos, sees payments and requests, and communicates with the team.
Information published on the website, including durations and price ranges, is general and approximate. The details of any project, including scope, price, dates and obligations, are set in the scope document and the contract signed by both parties, and the contract prevails in case of conflict.
Accounts
- Portal accounts are issued by us to our clients and the people they authorise. There is no public sign up.
- You are responsible for keeping your sign in details confidential and for everything done through your account. Change the temporary password at first sign in and tell us immediately if you suspect unauthorised use.
- The client's account owner may add team members and set their access, and the client is responsible for their actions inside the portal.
- Decisions and approvals recorded in the portal from an authorised account are treated as made by the client and are binding on the client.
Acceptable use
You agree to use the website and the portal only for lawful purposes, not to attempt to access data or accounts that are not yours, not to interfere with the operation or security of the service, and not to upload content that breaks the law or infringes the rights of others. We may suspend or close any account that does so.
Content and intellectual property
- The content of the website and the portal, including text, designs, logos and marks, is owned by or licensed to us and may not be copied or used without written permission.
- Content and files uploaded by the client remain the client's property, and the client grants us the right to use them to the extent needed to deliver the project.
- Ownership of project deliverables and the terms of their transfer are set in the contract. Under our service model, deliverables are handed over to the client's own accounts when the project is complete and the amounts due are settled as the contract provides.
Payments
Payments, their timing and the way they are settled are set in the scope document and the contract and are shown in the portal for tracking. Invoices and receipts shown in the portal are for record keeping, and the signed or officially issued documents remain the reference.
Durations and dates
The project counter and the station dates in the portal reflect what was agreed in the contract, including pauses when inputs or decisions on the client's side are late. Any compensation for delay on our side is as set in the contract and within the cap stated there.
Availability and changes
We aim to keep the service available at all times but do not guarantee that it will be uninterrupted or error free, and we may carry out maintenance, updates or changes to the service from time to time.
Limitation of liability
The website and the portal are provided as they are, without implied warranties beyond what the contract states. To the extent permitted by law, we are not liable for indirect or consequential losses arising from the use of, or inability to use, the website or the portal, and our total liability to a client in relation to any project does not exceed the amounts paid to us for that project, unless the contract provides otherwise.
Suspension and termination
We may suspend or end access to the portal when these terms are breached or when the contractual relationship ends, without prejudice to the client's right to receive their data and project deliverables as the contract provides.
Governing law
These terms are governed by the laws of the Kingdom of Saudi Arabia, and its courts have jurisdiction over any dispute arising from them, unless the contract provides another dispute resolution mechanism.
Changes
We may update these terms from time to time. The version published on this page applies from its date, and continuing to use the service after an update means you accept the updated terms.
